Easycourt.ca is NOT a law firm and does not provide legal advice. easycourt.ca is an online document preparation service that gives its users a general idea of the Ontario Small Claims Court process, as well as providing an automated software solution to individuals who choose to prepare their own legal documents.

This site contains general information on issues commonly encountered in the Ontario Small Claims Court. Easycourt.ca's document service also includes a review of your answers for completeness, spelling and grammar, as well as internal consistency of names and addresses. At no time does easycourt.ca review the information you have submitted to easycourt.ca for accuracy, factual veracity, legal sufficiency or correctness; nor does easycourt.ca draw legal conclusions, provide legal advice or apply the law to the facts of your particular situation. Easycourt.ca and its services are not a substitute for the advice of a paralegal or lawyer.

1. Are representing yourself in this legal matter. No client relationship or privilege is being created by using easycourt.ca

2. Understand the services that easycourt.ca is performing, and the cost of these services;

4. Are making all decisions concerning your legal matters and those decisions are your full responsibility. Acknowledge that easycourt.ca is not engaged and is not permitted to engage in the practice of law, including providing any kind of advice, explanation, opinion, or recommendation to a consumer about possible legal rights, remedies, defences, options, selection of forms or strategies.

5. Understand that you have the right to rescind any agreement for any easycourt.ca service within 24 hours of execution by providing easycourt.ca with a written statement to that effect. Upon rescission of the agreement for services, easycourt.ca will immediately return to you any fees paid, except fees for services that were actually, necessarily, and reasonably performed on your behalf with your knowledge and express written consent.

6. If you receive any communication from easycourt.ca, its agents, its employees or any other associated entity, which is Legal Advice, you understand that it is NOT a communication authorized by easycourt.ca and you agree to disregard it and report it to us immediately.

7. Agree to accept full responsibility for any use you make of easycourt.ca services and for obtaining any needed assistance from a properly licensed lawyer or paralegal to assess your situation.

For the purposes of these Terms, Legal Advice is defined to include the following:

1. Any legal related communication, work or service which, under the governing law of your jurisdiction, is only allowed to be performed by or under the supervision of a paralegal or lawyer;

2. Advice related to your specific legal or fact situation;

3. Advice relating to a determination of which legal document(s) is required to meet your legal;

4. Advice applying the law or drawing any legal conclusions;

5. Determining the legal consequences that will or could result from how you have created your legal document;

6. Whether you have included inappropriate, conflicting, or ambiguous information in your legal documents;

7. Whether you have omitted any necessary provisions or details from your legal documents; and

Additional Acknowledgements

1. Easycourt.ca retains the right to make changes to any of its programs as it sees fit.

2. All Affiliate Program payment schedules and percentages are subject to change with 30 days notice. Easycourt.ca also retains the right to terminate its relationship with any Affiliate or program partner at any time without penalty.

Refund Policy

Restrictions

To the maximum extent allowable under applicable law, you agree not to copy, recreate, publish, re-publish, lend, license, give away, look at the software source code, modify the software source code, post to an Internet web site, or use in an automated system, nor will you allow or assist a third party to do so.

The rights granted under these Terms and Conditions are granted to you only.

If you are an organization, the individual within your organization using this service is bound by these Terms and Conditions. If multiple individuals within your organization require access, a License or service must be purchased for each individual. The appointed individual may not be changed.

Easycourt.ca retains the right to prohibit organizations, groups, or individuals from using its websites or easycourt.ca services at its discretion.

Ownership of Intellectual Property

All ownership, copyright and other intellectual property rights to any easycourt.ca website, product or service belongs solely to easycourt.ca and its suppliers except as expressly licensed in these Terms and Conditions.

Without reducing or restricting any other remedies that easycourt.ca may be entitled to, you agree that to the extent allowable under applicable law any automated system using any easycourt.ca material will be the property of easycourt.ca.

NO WARRANTIES/GUARANTEES

Except as expressly provided in these Terms, the maximum liability of easycourt.ca is the amount paid to easycourt.ca by the customer.

Indemnification

You agree to indemnify and hold easycourt.ca, its directors, officers and employees, harmless from any claim, demand, or damage, including legal fees, asserted by any third party due to or arising out of the user's use of or conduct on the Site.

Revisions/Updates to Terms

Easycourt.ca reserves the right to change the Terms and Conditions or policies regarding the use of the Web Site at any time and to notify you by updating the Web Site.

Whole Agreement

These Terms and Conditions constitute the whole agreement between you and easycourt.ca

Governing Law

All transactions between you and easycourt.ca are governed by the laws of the Province of Ontario in Canada. You consent to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.

Personal Information and Privacy Policy

Easycourt.ca is committed to protecting the privacy of any personal information you may provide when visiting our Website. Part of that commitment is to explain what information may be collected and why, how it will be used and who may have access to it. Our practices have been designed to ensure compliance with the privacy provisions of the Municipal Freedom of Information and Protection of Privacy Act.

Personal information

1. Easycourt.ca does not sell or rent your personal information to any third party. We DO NOT sell, rent or provide outside access to our mailing list.

Encryption technology protects personal information during transmission. A notice stating "you are in a secure site" will be posted on our Website when you are in an encrypted session. A security icon will also appear in your browser window. Secure pages are not saved in temporary caches on a computer. Once you exit secure screens, those screens cannot be accessed again. If encryption is not available through a site, an alternative means of communication will be recommended.

Easycourt.ca Web server does not collect or retain your e-mail address in a database format although some Internet Service Providers may automatically include your e-mail address with your IP address (Internet Protocol).

"Any personal information that you provide to easycourt.ca during the course of your use of the Website, is used for the purpose only of completing the Small Claims Court forms that you have ordered. easycourt.ca does not use your personal information for any other purpose.

Logging Practices

Easycourt.ca logs HTTP requests to easycourt.ca Web server. These logs record the IP address of site visitors. An IP address is the number automatically assigned to the computer or to the ISP (Internet Service Provider) requesting a URL. Our logging is passive and we don't use technologies such as "cookies" or "Web bugs" to maintain any information on site visitors. Logged information, also known as clickstream data, is recorded in non-identifiable form. Log files are archived and used for systems analysis, maintenance and site evaluation.
